The philosophical implication that guides the issue addressed here is the following: how does the principle of the common constitute a frontal apophasis to the principle of property in contemporary democracies? I do not pretend to offer an exhaustive answer to this problem. However, I use the argumentative strategy of dividing this paper into three sections: (i) theoretically investigate the dialectical tension between the principle of the common and the principle of property; (ii) analytically observe the premise that the behavioral (...) practices of exacerbated individualism contribute as an act of aversion to the principle of the common and (iii) dwell on the articulation of the notion of the principle of the common as a factor that is present on the threshold between the philosophical vulgar and philosophical universal. Finally, I form some considerations that problematize the naturalized notion of the principle of property in current democracies, in view of the constituent power that the principle of the common holds in the perspective of achieving the well-being of human agents in contemporary community life. This paper intends to investigate the following problem: what is the meaning of the conception of good in Hegel's moral and juridical philosophy? Thus, aiming at the promotion of a consistent philosophical articulation for the understanding of such a question, I establish as argumentative strategy the tripartite topical structure, being the initial approach made in the introduction, in general lines, the contextualization of the morality problem. Next, I outline the meaning of understanding the conception of rational action of the subjective (...) will, which is established as a moment of Hegelian intersubjective morality. Moving on, I take as my line of argument the Hegelian juridical notion in which the good is approached as a concrete universal concept fully actualized and determined. Finally, I seek to understand how the grounding of good will is constituted in the transition to the sphere of eticity, in view of the movement of moral action of human agents in the argumentative structure of good and morality in Hegel's philosophy of justice. I outline the theoretical framework of, and three research programs within American speculative philosophy of science during the period 1900-1931. One program applies verificationism to research in psychology, one investigates the methodology of research programs, and one analyses scientific explanation and other scientific concepts. The primary sources for my outline are works by Morris Raphael Cohen, Grace Andrus de Laguna, Theodore de Laguna, Edgar Arthur Singer Jr., Harold Robert Smart, and Marie Collins Swabey. My comparison suggests that logical positivism was a proposal for substantially narrowing down and winding back American philosophy of science and was based on positions that were already problematized in the American context. -/- . In the preface to the Yale edition of Samuel Johnson’s poems, the editors remark that “for a modern reader who can recreate the situation in which [“London”] was written, it may still be exciting enough. But to one with less imaginative capacity or historical knowledge, its appeal lies in Johnson’s skillful handling of the couplet.”2 To assist us in re-creating the milieu of 1738, the editors supply the usual notes identifying various historical personages and events which are no longer in (...) the domain of common knowledge. In this respect they follow Johnson’s lead. “London” is manifestly an occasional poem; and its occasion—in part, Walpole’s timidity abroad and corruption at home—like all occasions, passed.3 Indeed it passed so quickly that Johnson himself felt called upon in the fifth edition to annotate, for instance, his mention of “the Gazetteer”: “the paper which at that time contained apologies for the Court.” By 1750 Walpole was long out of court, the Gazetteer extinct, and “London” as outdated as yesterday’s newspaper.For poems like “London” whose contents are neither au courant nor immortal but rather historical or simply dead, the Yale editors suggest two avenues of resuscitation: the reader may either restore the background by means of historical imagination or, failing that, admire Johnson’s couplet art, which perhaps has a better chance at perennial appeal. Either content or form, either history or art—both options require a sacrifice on our part, and that sacrifice is our occasion, our need. Even assuming that the poem’s context could be exhumed and that we could participate once again in all the rage of the “patriot” opposition to Walpole, Why would we want to? The problem is that not only “London” but the Walpole regime itself is now defunct. Yet the same question must be asked of the poem’s art, even and especially if it is eternal. Why are we interested in the aesthetic knowledge of couplets that have been drained of all substance? Is understanding “London” in either case an end in itself? The pure content of the poem is too concrete, its pure form too abstract, to answer our occasions. Thus to understand the poem as either history or art demands a leisure that has no exigencies and is therefore free for the bygone and ethereal.42. E.L. Hirsch, Jr. offers what he calls a "new and different theory" of meaning, one which radically reduces the role of the mens auctoris as the normative principle defining validity in literary interpretation.1 Clearly this essay marks a noteworthy shift in Hirsch's own thought, though in the history of hermeneutics such a reduction is (...) of itself hardly new. More interesting are the arguments Hirsch offers for this "correction" of his views, and in particular his thesis that in the process of application "responsible interpreters can adjust old concepts to new beliefs" and still say that they "have not really changed the text's meaning. They can properly say this, first of all, on grounds that... the original speech-intent subsumes new contents in the way that a concept subsumes examples, whether or not the examples were available to the original speaker. But in addition to this, the provisionality of speech sanctions a degree of adjustment in the original concepts as well" (p. 223). Application does not alter meaning if the new example can be subsumed under the original concept or if the original concept is itself originally provisional and adjustable. Thus Hirsch now concurs with Gadamer that application belongs to meaning and yet still dissents from Gadamer's thesis that application to situations unlike those the author envisioned necessarily changes the meaning. If determinacy of meaning is to be preserved, the essential question is, how far can sameness be unlike without becoming difference? Hirsch replies, "It appears... that meaning can tolerate a small revision in mental content and remain the same — but not a big revision.... In our ordinary talk about language, our judgment of sameness of meaning is based on our ad hoc judgment about the closeness of two contents" (p. 221). 139 140Philosophy and Literature Since I (and, I think, Gadamer) agree in great part with this conclusion, Hirsch's theory in my view does not need to be refuted and replaced with something new and different. Rather, in the spirit of his essay, I propose to adjust and build on it — by showing first that the development of Hirsch's argument rehearses Kant's movement from the first Critique to the third, second that the result of merging the two Critiques is unacceptable, and finally that Gadamer's reading of Kant anticipates and refines Hirsch's new theory while avoiding its unacceptable consequences. "The first amendment I must make in my original explanation of the distinction between meaning and significance is to reject my earlier claim that future applications of meaning, each being different, must belong to the domain of significance" (p. 210). In this first phase of his argument, Hirsch argues that the details of literary texts exemplify concepts that are themselves broader than the particulars that exemplify them. In Shakespeare 's sonnet 55, "marble" exemplifies what will last long but not forever. Just as the sonnet itself offers additional instances of this concept, so also the interpreter can find still other, more modern examples of it. Even if Shakespeare did not mention these modern examples and could not be said to have had them in mind, yet they too belong to the poem's self-same meaning if they can be subsumed under the original concept and thus belong to its extension. We can always find more examples, then, and in Hirsch's view this means that through its applications a poem can always become fresh again without altering its meaning. But here's the rub: if new instances are always to be found and thus no instance ever exhausts a concept, then no instance ever fully exemplifies a concept. Every example is a bad example, and Shakespeare would have done better to stick to conceptual language in the first place. If this conclusion is unacceptable, then we can reverse it. When the purpose is only to exemplify a concept, the difference between two examples (say, marble and steel) can be ignored as irrelevant. But it is nonetheless real. Some recent developments in Artificial Intelligence—especially the use of machine learning systems, trained on big data sets and deployed in socially significant and ethically weighty contexts—have led to a number of calls for “transparency”. This paper explores the epistemological and ethical dimensions of that concept, as well as surveying and taxonomising the variety of ways in which it has been invoked in recent discussions. Whilst “outward” forms of transparency may be straightforwardly achieved, what I call “functional” transparency about the inner (...) workings of a system is, in many cases, much harder to attain. In those situations, I argue that contestability may be a possible, acceptable, and useful alternative so that even if we cannot understand how a system came up with a particular output, we at least have the means to challenge it. There is growing philosophical interest in “affective injustice”: injustice faced by individuals specifically in their capacity as affective beings. Current debates tend to focus on affective injustice at the psychological level. In this paper, I argue that the built environment can be a vehicle for affective injustice — specifically, what Wildman et al. (2022) term “affective powerlessness”. I use resources from ecological psychology to develop this claim. I consider two cases where certain kinds of bodies are, either intentionally or unintentionally, (...) deprived of access to goods affording the development and maintenance of their subjective well-being: hostile architecture and masking practices in autism. This deprivation, I argue further, leads to a significant weakening and diminishment of their spatial agency, hinders their well-being, and in so doing gives rise to a pervasive experience of affective powerlessness. By drawing attention to these themes, I show that an ecological approach helpfully supplements existing approaches. It highlights how affective injustice can emerge via the way bodies are positioned in space, and the central role that built environments play in determining this positioning. (shrink)

One of liberalism’s core commitments is to safeguarding individuals’ autonomy. And a central aspect of liberal social justice is the commitment to protecting the vulnerable. Taken together, and combined with an understanding of autonomy as an acquired set of capacities to lead one’s own life, these commitments suggest that liberal societies should be especially concerned to address vulnerabilities of individuals regarding the development and maintenance of their autonomy. In this chapter, we develop an account of what it would mean for (...) a society to take seriously the obligation to reduce individuals’ autonomy-related vulnerabilities to an acceptable minimum. In this article, we describe a hitherto undocumented fallacy-in the sense of a mistake in reasoning-constituted by a negativity bias in the way that people attribute motives to others. We call this the "worst-motive fallacy," and we conducted two experiments to investigate it. In Experiment 1, participants expected protagonists in a variety of fictional vignettes to pursue courses of action that satisfy the protagonists' worst motive, and furthermore, participants significantly expected the protagonist to pursue a worse course of action than (...) they would prefer themselves. Experiment 2 was a preregistered attempted replication of Experiment 1, including a bigger range of vignettes; the first effect was not replicated for the new vignettes tested but was for the original set. Also, we once again found that participants expected protagonists to be more likely than they were themselves to pursue courses of action that they considered morally bad. We discuss the worst-motive fallacy's relation to other well-known biases as well as its possible evolutionary origins and its ethical consequences. (shrink)

This first volume in the four-volume series The Moral Limits of the Criminal Law focuses on the "harm principle," the commonsense view that prevention of harm to persons other than the perpetrator is a legitimate purpose of criminal legislation. Feinberg presents a detailed analysis of the concept and definition of harm and applies it to a host of practical and theoretical issues, showing how the harm principle must be interpreted if it is to be a plausible guide to the lawmaker.

This book traces how such a seemingly immutable idea as measurement proved so malleable when it collided with the subject matter of psychology. It locates philosophical and social influences reshaping the concept and, at the core of this reshaping, identifies a fundamental problem: the issue of whether psychological attributes really are quantitative. It argues that the idea of measurement now endorsed within psychology actually subverts attempts to establish a genuinely quantitative science and it urges a new direction. The author begins by demonstrating how contemporary philosophers, whether engaged in case-driven analysis or seeking reflective equilibrium, rely on intuitions as evidence for their theories. The author then provides an account of the nature of philosophical intuitions and distinguishes them from other psychological states. I present a perceptual account of other minds that combines a Husserlian insight about perceptual experience with a functionalist account of mental properties.

Phylogenetic trees are meant to represent the genealogical history of life and apparently derive their justification from the existence of the tree of life and the fact that evolutionary processes are treelike. However, there are a number of problems for these assumptions. Here it is argued that once we understand the important role that phylogenetic trees play as models that contain idealizations, we can accept these criticisms and deny the reality of the tree while justifying the continued use of trees (...) in phylogenetic theory and preserving nearly all of what defenders of trees have called the “importance of tree thinking.”.
